Welcome to NihongoListening.

These Terms of Use ("Terms") govern your access to and use of the NihongoListening website and its Japanese listening practice features.

By accessing or using NihongoListening, you agree to these Terms. If you do not agree with them, please do not use the service.

1. About NihongoListening

NihongoListening is an educational service designed to help users practice Japanese listening comprehension.

The current service provides features such as:

• Japanese listening exercises;
• JLPT-style practice for different proficiency levels;
• multiple-choice questions;
• transcripts;
• answer feedback;
• practice-session results.

NihongoListening is intended for independent language-learning and educational purposes.

2. Relationship with the JLPT

NihongoListening provides JLPT-style practice materials designed to help learners practice skills relevant to the Japanese-Language Proficiency Test ("JLPT").

Unless explicitly stated otherwise, exercises provided by NihongoListening are independently created practice materials and are not official JLPT examination questions.

NihongoListening is not affiliated with, endorsed by, sponsored by, or officially connected with:

• The Japan Foundation;
• Japan Educational Exchanges and Services ("JEES");
• the official JLPT administrators or local JLPT testing organisations.

References to "JLPT", "N5", "N4", "N3", or other JLPT levels are used only to describe the intended approximate level and purpose of the practice materials.

All third-party names, trademarks, and other intellectual-property rights remain the property of their respective owners.

3. No Guarantee of JLPT Results

NihongoListening is a practice tool.

We do not guarantee that:

• the exercises exactly reproduce the content or difficulty of an official JLPT examination;
• completing exercises will result in a particular JLPT score;
• using NihongoListening will result in passing the JLPT;
• any estimated strengths, weaknesses, or practice results accurately predict official examination performance.

Practice scores and feedback are provided for educational purposes only.

Your actual JLPT performance may differ substantially from your results on NihongoListening.

4. Permitted Use

You may use NihongoListening for personal and educational purposes.

You may:

• complete listening exercises;
• review transcripts and answers;
• use the materials for your own Japanese-language study;
• share links to publicly accessible NihongoListening pages.

Unless we explicitly give permission, the service and its content may not be reproduced, distributed, republished, sold, or incorporated into another product or database beyond what is permitted by applicable law.

5. Intellectual Property and Copyright

Unless otherwise stated, NihongoListening's original materials and website content are owned by or licensed to the operator of NihongoListening.

This may include:

• original listening exercises;
• question texts;
• answer options;
• explanations;
• original audio created for the service;
• transcripts;
• illustrations and visual assets;
• website design;
• branding;
• software and other original content.

Your use of NihongoListening does not transfer ownership of this content to you.

You may not, without permission:

• copy or redistribute substantial collections of exercises;
• publish NihongoListening exercises on another website, app, dataset, or service;
• sell or commercially exploit NihongoListening content;
• systematically download or archive the question database or audio library;
• remove copyright or ownership notices;
• represent NihongoListening content as your own.

These restrictions do not limit uses that cannot legally be restricted under applicable copyright law.

6. Prohibited Uses

You must not use NihongoListening in a way that:

• violates applicable law;
• interferes with the operation or security of the website;
• attempts to gain unauthorised access to servers, databases, or administrative systems;
• introduces malware or malicious code;
• intentionally overloads or disrupts the service;
• uses automated scraping, crawling, downloading, or extraction to reproduce substantial parts of the exercise database;
• bypasses technical restrictions or access controls;
• uses the service to send spam or abusive communications;
• falsely suggests that you represent NihongoListening;
• falsely suggests an official relationship between NihongoListening and the JLPT, The Japan Foundation, JEES, or another organisation.

Reasonable use of ordinary search-engine crawlers and other services authorised by NihongoListening is not prohibited by this section.

7. Availability and Changes to the Service

NihongoListening is currently an evolving educational service.

We may at any time:

• add or remove exercises;
• correct or update content;
• change the design or functionality;
• modify available JLPT levels;
• introduce new practice modes;
• suspend particular features;
• introduce paid features in the future;
• temporarily or permanently discontinue part or all of the service.

We do not guarantee that NihongoListening will be available continuously or without interruption.

Temporary interruptions may occur because of:

• maintenance;
• technical problems;
• server outages;
• software updates;
• security issues;
• third-party provider failures;
• circumstances outside our reasonable control.

If paid services are introduced in the future, additional or updated terms may apply before a user purchases them.

8. Accuracy of Educational Content

We make reasonable efforts to provide useful and accurate Japanese-learning materials.

However, NihongoListening may contain:

• mistakes;
• translation errors;
• audio errors;
• technical problems;
• ambiguous questions;
• outdated information.

We may correct or replace educational content at any time.

9. Third-Party Services and Links

NihongoListening may rely on third-party infrastructure or services, such as:

• hosting providers;
• email providers;
• analytics services.

We do not control third-party websites or services and are not responsible for their independent content, availability, privacy practices, or terms.

Use of third-party services may be subject to their own terms and policies.

NihongoListening is provided on an "as is" and "as available" basis.

To the maximum extent permitted by applicable law, we do not make warranties that:

• the service will always be available;
• every exercise will be error-free;
• every translation or explanation will be completely accurate;
• the service will meet every user's learning needs;
• using NihongoListening will produce a particular language-learning or examination result.

Nothing in these Terms excludes warranties or rights that cannot legally be excluded.

12. Limitation of Liability

To the maximum extent permitted by applicable law, NihongoListening and its operator will not be responsible for indirect, incidental, consequential, or similar losses arising from:

• reliance on practice scores or educational content;
• JLPT examination results;
• temporary service unavailability;
• loss of practice history;
• technical failures;
• third-party services;
• unauthorised use of the service outside our reasonable control.

NihongoListening is provided primarily as a free educational service, and users should not rely on it as their sole source of JLPT preparation.

Nothing in these Terms limits or excludes liability where such limitation or exclusion is prohibited by applicable law, including liability that cannot lawfully be excluded because of intentional misconduct, gross negligence, or mandatory consumer-protection rules.

13. Privacy

Your use of NihongoListening is also subject to our Privacy Policy.

The Privacy Policy explains, among other things:

• what personal data we process;
• optional analytics;
• email subscriptions;
• cookies and browser storage;
• retention periods;
• international data transfers;
• your privacy rights.

Where consent is required for optional data processing, refusing consent does not prevent you from using the core listening practice.

14. Children and Minors

NihongoListening is an educational service that may be used by younger learners.

If you are a minor, you should use the service with the involvement of a parent or legal guardian where required by applicable law.

Optional activities involving personal data, such as email subscriptions or analytics consent, may require parental or guardian permission depending on your age and country.

15. Suspension of Access

We may restrict or block access to NihongoListening where reasonably necessary to:

These Terms are governed by the laws of the Russian Federation, without regard to conflict-of-law principles.

However, this choice of law does not deprive you of mandatory consumer or other statutory protections that apply to you under the laws of your country of residence and that cannot legally be waived by contract.

18. Disputes and Jurisdiction

We encourage you to contact us first if you have a concern or dispute so that we can try to resolve it informally.

To the extent permitted by applicable law, disputes concerning these Terms or the use of NihongoListening will be subject to the jurisdiction of the competent courts of the Russian Federation.

This does not prevent a consumer from relying on mandatory rights to bring a claim before another competent court where such rights are provided by applicable law.

19. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid provision will be interpreted or limited only as far as reasonably necessary to make it enforceable where permitted.
